Mobis Festive Contest

By participating in the "Mobis Festive Contest" (“Contest”), you agree to the following terms and conditions. Please read these terms and conditions carefully before participating in this Contest.

(People participating or seeking to participate in the Contest shall individually be referred to as "Participant" and collectively as "Participants".)

TERMS AND CONDITIONS:

CONTEST DETAILS

  1. These terms and conditions shall apply to "Mobis Festive Contest" (“Contest”), sponsored by Mobis India Limited ("Mobis India") wherein Participant can participate, voluntarily, by their own free choice by posting a photo or video of their Hyundai passenger car (“Vehicle”) decorated with Hyundai Genuine Accessories (“Accessories”) between 18th Oct, 2024 to 5th Nov, 2024 (both dates are inclusive).
  2. The Contest is subject to all applicable central laws of India and state laws and regulations.

AGREEMENT TO TERMS AND CONDITIONS:

  1. By participating in this Contest, Participants fully and unconditionally agree to accept and abide by these terms and conditions mentioned or referred under this Contest as well as the decisions of Mobis India, which shall be final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize is subject to complying all requirements set forth herein.
  2. Mobis India reserves the right to exclude any Participant from the Contest at any time on the grounds including but not limited to entries that are incomplete, offensive, or otherwise in violation of the Contest’s terms and conditions.
  3. Mobis India reserves the right to amend or terminate this Contest at any time without serving any notice, for any reason, including but not limited to unforeseen circumstances or technical issues.
  4. In the event of cancellation or termination, no compensation will be provided to the Participants by Mobis India.

ELIGIBILITY:

  1. This Contest is applicable only for the individual but not applicable for the institutional, organisational or corporate purchases.
  2. This Contest will be open to all the residents of India with the exception of Mobis India’s employees and their families, Mobis India’s distributors, retailers, other channel partners, agencies/entities associated with Contest (including their employees).
  3. Participation by people below 18 years of age shall not be allowed.

PERSONAL DATA:

  1. By participating, the Participant consents the collection, storage, disclosure, usage, sharing and processing of the personal information by Mobis India and its channel partner for the purposes of administering the Contest, verifying entries, announcing winners, and distributing prizes, in accordance with applicable data protection laws of India.

PROGRAM PERIOD AND ELIGIBLE PRODUCTS:

  1. The Contest will commence on 18th Oct, 2024 and will end on 5th Nov, 2024 (both dates are inclusive).
  2. This Contest shall run across all Vehicles manufactured by Hyundai Motor India Limited (“HMIL”).
  3. The Participant shall be the owner of HMIL’s Vehicle or direct blood relative (means parents, children, siblings only) of the owner.
  4. The Participants must follow Mobis India’s official social media accounts (i.e. Facebook, Instagram, twitter) and post a photo or video of their Vehicle decorated. The more Accessories Participant use, higher the chances of winning.
  5. The Participants shall use the hashtag “#CelebratewithMobis” while posting phots or videos and tag Mobis India in the post.
  6. The Participants can make multiple entries however each entry must be unique.
  7. By submitting the entry, the Participant confirms that he/she is the rightful owner of the Vehicle, or direct blood relative (means parents, children, siblings only) of the owner and the photos or videos posted shall not in any way be obscene, vulgar, disrespectful or defamatory in any manner nor shall be in infringement or in violation of any intellectual property rights of third parties and/or applicable laws.
  8. No third-party or unauthorized content (images, videos, music, etc.) should be included in the post by Participants without appropriate permissions.
  9. Mobis India reserves the right to disqualify any entry that is deemed inappropriate, irrelevant, or that violates any of these terms and conditions.
  10. Participants enter the Contest at their own risk and are responsible for ensuring that any decorations or modifications made to their Vehicle are safe and comply with all applicable laws and regulations.

WINNER SELECTION:

  1. The winners will be selected based on criteria determined by Mobis India and jury decision and shall not be held liable to explain the process by which the winner has been chosen. The decision of Mobis India is final and binding. No correspondence or appeals will be entertained regarding the selection process or results.
  2. Mobis India reserves the right to disqualify any entry that is deemed inappropriate, irrelevant, or that violates any of these terms and conditions at its sole discretion.
  3. In the event that the winner does not take the prize or courier undelivered, then the prize shall be forfeited by Mobis India.
  4. Prizes must be taken as offered and cannot be varied. The right to claim the prize cannot be transferred by the Participant/winner to any other person. No cash alternatives or alternative prizes are available.
  5. The images of the prizes, if any, depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made. All images used to depict prizes are proprietary to the respective brand/manufacturer.
  6. All taxes, levies and charges on the prize, if any, will be borne and pay by winner.

WINNERS ANNOUNCEMENT AND DISTRIBUTION OF PRIZE:

  1. All the winners will be announced on or before 15th Nov, 2024 on Mobis India’s social media platforms.
  2. Mobis India will announce 9 (nine) winners under this Contest.
  3. Each winner will be required to submit the following documents to Mobis India:
  • The original invoice of each Accessories purchased;
  • Self-attested copy of any one photo identity proof and address proof (e.g. Valid Driver's license, Voter's Identity card, Valid Indian Passport, PAN card);
  • Proof of ownership of Vehicle (Registration certificate of Vehicle);
  • Any documentary proof for direct blood relationship (PAN card, birth certificate, family ID etc.);
  • Tax certificate, if applicable;
  • Any other document required by Mobis India.
      4. Mobis India after announcing the winner and post validation and verifying the authenticity of all the documents will dispatch the prizes to the respective winners. The prize will be dispatched to the respective winners of the prizes within 90 working days of announcement.
      5. In case the Participant name is not published as winner, it shall automatically mean that the Participant's name has not come through the selection process and he/she is not a winner.
      6. Mobis India is not responsible for any technical issues, such as delays, disruptions, or lost entry/ post, resulting from factors beyond its control.

Note : Participants must also submit valid invoices or documentation for each Accessories used in decorating their Vehicle.

PUBLICITY:

  1. By accepting the prize(s), the winner undertakes and irrevocably and unconditionally permits Mobis India to cover the Contest through various media including newspapers, radio television news channels, internet, point of sale materials, public events etc., and the winner shall not raise any objection, protest or demur to such coverage or in this regard.
  2. The winner hereby grants to Mobis India, the right to use their photograph(s), sound-bites, write-ups, video in any media found suitable by Mobis India i.e. radio, print, digital, electronic or point-of-sale media.

INTELLECTUAL PROPERTY:

  1. All right, title and interest, including but not limited to the intellectual property rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with Mobis India at all times.
  2. All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Mobis India upon submission and become the property of Mobis India exclusively. Mobis India may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Mobis India.
  3. The Participant agrees to indemnify Mobis India against any claims, damages, or liabilities arising out of any intellectual property violations associated with the post/entry.

DISPUTE:

  1. The rights and obligations of the Participants and/or Mobis India and/or channel partner of this Contest, shall be governed and construed in accordance with the laws of India and the courts of competent jurisdiction at New Delhi shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Contest.
  2. Except where prohibited by law, the Participant is not allowed to bring any claim against Mobis India (or any other third-party beneficiary) more than one year after the claim arises.

FORCE MAJEURE

  1. Mobis India or its channel partner or its partner agency shall not be liable for any failure or delay to fulfil any of our obligations hereunder, to the extent the same is caused by force majeure events such as floods, earthquakes, fire, riots, civil unrest, war (declared or not), strikes and lock-outs, or any other circumstances beyond the reasonable control of Mobis India or its partner agency and shall not be liable to compensate the participant in these circumstances. Mobis India shall not be accountable / liable for any disruptions / stoppages / interruptions or cancellation of the Contest due to any government restrictions.

INDEMNITY

  1. The Participant understands and agrees to indemnify and hold harmless Mobis India, its parents, subsidiaries, affiliates, officers and employees, channel partner, agencies harmless, including costs and attorneys' fees, from any claim, loss, demand, damages, fees, liabilities whether civil or criminal, compensation, whatsoever made by any third party and/or Participant  and/or winner due to or arising out of this Contest.

LIMITATION OF LIABILITY

  1. Without limiting the foregoing, Mobis India and its affiliates will not be liable under any law, for any indirect, incidental, punitive, and consequential damages, including, but not limited to loss of profits, business interruption, and/or loss of information or data.

SURVIVAL

  1. The Participant agrees that the limitations of liability and indemnities in these terms and conditions will survive even after termination, expiry or distribution of prize of the Contest or features/benefits.

WARRANTIES/PRODUCT RELATED QUERIES:

  1. The prizes will be governed by the normal terms of warranties and/ or guarantees, of the manufacturer of the prizes and Mobis India or its partner agency or its channel partner shall not be held liable or responsible for the same. The Prize winner shall contact the manufacturer service centre directly for any issue, whatsoever, related with the prize.
  2. Any queries/ doubts/information related to the functioning of the prizes (assured prize/monthly regular prize) shall be directly directed to the manufacturer/distributor of the prizes that shall be solely liable and responsible for any/all queries related to it.

MISCELLANEOUS:

  1. There is no purchase or payment required to enter or win the Contest. 
  2. Mobis India or its partner agency for the Contest shall not be responsible for any NDNC (National Do Not Call) registry regulation that comes into play. All participants who participate hereby agree and give express consent to Mobis India and its partner agency for the Contest that even if they are registered under NDNC, DND (Do Not Disturb), Mobis India or its partner agency for the Contest, will have the valid authority to call such shortlisted participants, by virtue of them having voluntarily participated in this Contest.
  3. Mere participation in this Contest does not entitle a Participant to a prize unless all other terms and conditions are fully complied with. Any fraudulent conduct on the part of the Participant shall disentitle the Participant to receive the prize under this Contest.
  4. Mobis India reserves the right to change, defer, alter or cancel this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of Mobis India in this regard and in general with respect to this Contest and the terms and conditions thereto shall be final and binding.
  5. The decision of Mobis India shall be final in all regards and no communication, queries or complaints shall be entertained in this regard. None of the provisions of these terms and conditions shall be deemed to constitute a partnership or agency between any Participant and Mobis India and the Participant shall not have the authority to bind Mobis India in any manner whatsoever.
  6. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of Mobis India or its Partner Agency.
  7. If a Participant is dissatisfied with the Contest and/or the terms and conditions of the Contest, his/her sole and exclusive remedy is to not to participate in the Contest.
  8. Participating in this Promotion is deemed acceptance of the above terms and conditions.

Mobis India assumes no responsibility for any incorrect, inaccurate, or incomplete information, whether caused by entrants, tampering, or by any of the equipment or programming associated with or utilized in the Contest.
